Terms & Conditions

We want your pet to enjoy our products as much as Bramble does. We have some Terms & Conditions for all orders. By ordering from Bramble’s Bakes, you are agreeing to the following Terms & Conditions. 

 

These Terms and Conditions set out the terms under which goods are sold by Bramble’s Bakes (“we” or “us” or “our”) to customers through our website: www.bramblesbales.co.uk (“our website”). Please read these Terms of Sale carefully and ensure that you understand them before ordering any goods from our website. You will be required to read and accept these Terms of Sale when ordering goods. If you do not agree to comply with and be bound by these Terms of Sale, you will not be able to order goods through our website. These Terms of Sale, as well as any and all contracts are in the English language only. 

 

Definitions: 

 

In these Terms and Condition, unless the context otherwise requires, the following expressions have the following meanings: 

  • “Contract” - means a contract for the purchase and sale of Goods. 

  • “Goods” - means the goods sold by Us through Our Website. 

  • “Order” - means your order for Goods. 

  • “Order Confirmation” - means Our acceptance and confirmation of your Order. 

  • “Order Number” - means the reference number for your Order. 

  • “We/Us/Our” – means Bramble’s Bakes. 

 

Currency: 

 

All prices are in GBP (British Pounds). 

 

Prices: 

 

All prices on our website are the price that you will pay.  

 

Payment: 

 

Payment is required to confirm all orders and no booking or order is guaranteed until payment has been received. For orders booking via our website, payment in full is required at the time of ordering. We reserve the right to cancel any order still awaiting payment on the delivery date. 

 

Photographs: 

 

We reserve the right to use photographs of orders we prepare on our website and on social media (Facebook, Instagram and Twitter). If you would like to specifically request that we do not use pictures of your order, or that we provide you with a picture of your order, we will usually be happy to do so but you must let us know at the time of ordering.  

 

Goods: 

 

Images of goods are for illustrative purposes only. There may be slight variations in colour between the image of a product and the actual product sold due to differences in device displays and lighting conditions. 

 

Edible images may be changed to similar images at our discretion.  

 

Due to the handmade nature of the goods sold through our website, there may be up to a slight variance in the size and weight of those goods between the actual goods and the description. We will always display the minimum product weight you will receive. 

 

As all of our edible goods (all cakes, biscuits sweets and chocolates etc) are handmade some details may vary slightly (e.g. thickness of biscuits, colour and shapes).  

 

Where appropriate, you may be required to select the required design or colour, of the goods that you are purchasing. 

 

We cannot guarantee that goods will always be available. Where an item is not available it will be marked as Out of Stock on the website and you will be unable to place an order for that item. 

 

Packaging 

 

We reserve the right to alter the packaging used to allow your order to be fulfilled. Occasionally supply issues may mean that the packaging has a cardboard lid rather than an acetate one, for example. Biscuit tin orders will always be supplied in a tin, it may be a slightly different size, such as square instead of rectangular. The products inside will be the same weight. 

 

We actively re-use external packaging that we receive from our suppliers. We believe it would be environmentally irresponsible not to. 

 

Gift Message 

 

We reserve the right not to send a gift message that may contain offensive and/or inappropriate content. We will not accept racism, sexism or other nastiness. If we think it will upset Bramble we may have to reject it. 

 

Use of Our Website: 

 

Use of our website is subject to the terms contained within our Privacy and Cookie Policy. Please ensure that you have read this carefully and that you understand the contents. 

 

Prices on our website are inclusive of VAT. 

 

Orders – How contracts are Formed 

 

Our website will guide you through the ordering process. Before submitting your order you will be given the opportunity to review your order and amend it. Please ensure that you have checked your order carefully before submitting it. 

 

If, during the order process, you provide us with incorrect or incomplete information, please contact us as soon as possible. If we are unable to process your order due to incorrect or incomplete information, we will contact you to ask to correct it. If you do not give us the accurate or complete information within a reasonable time of our request, we will cancel your order and treat the contract as being at an end. 

 

No part of our website constitutes a contractual offer capable of acceptance. Your order constitutes a contractual offer that we may, at our sole discretion, accept. Our acceptance is indicated by us sending you an order confirmation by email. Only once we have sent you an order confirmation will there be a legally binding contract between us and you. 

 

In the unlikely event that we do not accept or cannot fulfil your order for any reason, we will explain why in writing. No payment will be taken under normal circumstances. If we have taken payment any such sums will be refunded to you as soon as possible and in any event within 30 days. 

 

Delivery: 

 

All deliveries are undertaken by Royal Mail or one of our couriers. Please ensure someone is available at the delivery address on the day of your order. 

Unfortunately we cannot guarantee that delivery instructions provided to us will be carried out and are not liable for any errors made by Royal Mail or courier companies and can’t be held liable for delays in delivery or lost or damaged parcels.

 

We cannot accept any liability for the treatment of your order or mishandling once a delivery has been made and the package(s) signed for. 

 

Collection: 

 

Collection is only available where it has been agreed in advance. Once a date and time for collection has been agreed this must be adhered to. There is no guarantee of availability to collect your order outside of the agreed time. 

Refunds & Returns: 

 

All our cakes, cupcakes and biscuits are baked to order and we do not accept returns unless there is a fault. 

 

Refunds, credit notes or a replacement order to the same value will be given only in the event that you receive the incorrect product or if the products are shown to be of unsatisfactory quality. Should this be the case, or if you are in any way unsatisfied with the condition or quality of your goods upon arrival you must contact us within 24 hours of receipt. We will not accept liability for any complaints received after this time. 

 

Order Cancellation: 

 

If you need to change the date or details of your order or cancel it altogether, please contact us as far in advance as possible. If the order is in the process of being made it cannot be cancelled. 

 

Online orders cancelled 28 days or more before the shipping/delivery/collection date will receive a full refund on the order. 

 

Online orders cancelled 7 days or more before the shipping/delivery/collection date will receive a full refund on the order total less deposit. Deposit is built into online orders at 25%. 

 

Online orders cancelled between 3 and 6 days before the shipping/delivery/collection date will be entitled to a 50% refund. A credit note may be provided at our discretion. 

 

Online orders cancelled within 48 hours of the shipping/delivery/collection date will not be entitled to a refund. A credit note may be provided at our discretion. 

 

For all orders which are to be shipped/posted, an additional time frame of 3 days on all conditions applies to allow for the shipping time before delivery. 

 

Any refunds due under this clause will be made using the same payment method that you used when ordering the goods. 

 

Events Outside of Our Control (Force Majeure) 

 

We will not be liable for any failure or delay in performing our obligations where that failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: power failure, internet service provider failure, strikes, lock-outs or other industrial action by third parties, riots and other civil unrest, fire, explosion, flood, storms, earthquakes, subsidence, acts of terrorism (threatened or actual), acts of war (declared, undeclared, threatened, actual or preparations for war), epidemic or other natural disaster, or any other event that is beyond our reasonable control. 

 

If any event described under this clause occurs that is likely to adversely affect our performance of any of our obligations under these Terms of Conditions: 

  • We will inform you as soon as is reasonably possible. 

  • We will take all reasonable steps to minimise the delay. 

  • To the extent that we cannot minimise the delay, our affected obligations under these Terms and Conditions (and therefore the contract) will be suspended and any time limits that we are bound by will be extended accordingly. 

  • We will inform you when the event outside of our control is over and provide details of any new dates, times, or availability of goods as necessary. 

  • If the event outside of our control continues for more than 30 days, we will cancel the contract and inform you of the cancellation. Any refunds due to you as a result of that cancellation will be paid to you as soon as is reasonably possible and in any event within 30 days of the date on which the contract is cancelled and will be made using the same payment method that you used when ordering the goods. 

 

Complaints and Feedback 

 

We always welcome feedback from our customers and, whilst we always use all reasonable endeavours to ensure that your experience as a customer of ours is a positive one, we nevertheless want to hear from you if you have any cause for complaint.

Amendments 

 

We may revise these Terms and Conditions from time to time in response to changes in relevant laws and other regulatory requirements. At time of order you are asked to confirm acceptance of the terms and conditions. The current version of Terms and Conditions will those available on our website at the time of order.
